第一條：型號建議寫死。 合同里建議寫清品牌、型號、噸位、出廠編號?？陬^說“20噸機”不行——不同品牌20噸機斗容、油耗差很多。土方工程選通用型（斗容1.0-1.2m?）；礦山巖石選加強型；狹小空間選小型機（寬≤1.5m）。

Article 1: The model must be written dead. The brand, model, tonnage, and factory number must be clearly stated in the contract. Saying '20 ton machine' verbally is not acceptable - there are significant differences in bucket capacity and fuel consumption among different brands of 20 ton machines. Select universal type for earthwork engineering (bucket capacity 1.0-1.2m?); Reinforced rock selection for mining; Choose a small-sized machine (width ≤ 1.5m) for narrow spaces.

第二條：計費方式要明確。 按臺班（8-10小時/班）還是按月？超時怎么算？。日租通常2000-2500元/天（含司機）。月租7000-20000元，年租約月租10-11倍。短期（1-3月）選日租或月租，長期（6月以上）選年租。

Article 2: The billing method should be clear. By shift (8-10 hours/shift) or by month? How is timeout calculated?. Daily rent is usually 2000-2500 yuan/day (including driver). The monthly rent is 7000-20000 yuan, and the annual lease is 10-11 times the monthly rent. Short term (1-3 months) choose daily or monthly rent, and long-term (above June) choose annual rent.

第三條：油費誰出？ 通常租賃費不含燃油。但建議約定油品標(biāo)準(zhǔn)（如0#柴油）。出租方用劣質(zhì)油損壞設(shè)備算誰的？合同寫清楚。

Article 3: Who will bear the cost of fuel? The rental fee usually does not include fuel. But oil standards must be agreed upon (such as 0 # diesel). Who is responsible for the lessor damaging the equipment with inferior oil? The contract should be clearly written.

第四條：司機算誰的？ 日租月租通常含司機工資。包年可能不含。自行雇司機建議確認(rèn)資質(zhì)。司機操作不當(dāng)損壞設(shè)備，責(zé)任劃分要明確。

Article 4: Who is the driver counted as? The daily and monthly rent usually includes the driver's salary. The annual package may not include it. Self employed drivers must confirm their qualifications. The driver's improper operation causing damage to the equipment requires clear division of responsibility.

第五條：維修責(zé)任劃清楚。 年租通常出租方負(fù)責(zé)常規(guī)保養(yǎng)，承租方負(fù)責(zé)易損件更換。但故障停機算誰的時間？租金扣不扣？合同里建議有“故障處理條款”——一般約定維修超過24小時扣減相應(yīng)租金。

Article 5: Clear delineation of maintenance responsibilities. The lessor is usually responsible for routine maintenance for annual rent, while the lessee is responsible for replacing vulnerable parts. But whose time is counted for the downtime caused by the malfunction? Is the rent deducted or not? There must be a "fault handling clause" in the contract - it is generally agreed that if the repair exceeds 24 hours, the corresponding rent will be deducted.
